Disclaimer document?

Does anyone out there have a disclaimer that waives responsibility for unforeseen damage to like a customers yard, a stray rock that flies up and breaks a window or something of the sort they might be willing to share? I have insurance to cover major damage should a branch fall on a house, car etc..? I'm just looking for something for CYA. I haven't had a problem so far..but I figure it might be worth looking into with everyone so sue happy these days.
 
For random rocks through windows and the like I take care of it out of my pocket, give them a break on the price or do extra work ( That tree over there could use a good trimming, Mr. Soandso. ) even though it was unforeseen. I figure I'd rather pay for it when that rare occasion comes up than risk putting the thought into the HO's head that something COULD go wrong prior to getting their signature on the line. Some guys do put disclaimers in for yards, not my style though. If I sense the HO will be goofy about that little stuff I'll put a higher $ on the job to make it worth my trouble to not make a dent.
 
If you were really into it, I would say to put a waiver in for damage to septic systems, dry wells, sink holes, dog fences, etc. etc. Things that the client might forget to tell you about, or if they flat out don't know where it is. I've had it happen before... client says that the leach fields go to a certain point and that's it. Well we go in with an excavator on a clearing job and guess what we hit? I know other people have run into problems in the past where they drove their trucks over an area that was supposed to be alright, and wound up putting their trucks through old dry wells, sink holes, sess pools, etc.
 
I didn't know exactly what all I would have it cover.I thought I'd run it by you guys and see if it might be an idea worth exploring..seems like you can't be too carefull these days..
 
We put in all our contracts. Not responsible for any lawn damage. Also when grinding stumps. we are not responsible for damage to any underground utilies not marked by DIG SAFE. In over 40 years I had one customer refuse to sign off on lawn damage. In fact the tree still stands today.

Ive seen a firewood sized stub fly 100-120 feet up into the air and land with a thud in the neighbors yard after dropping a butt log onto some limbs as cushion

I always pay if anything like that happens. My brother knocked the head off a garden statue one time (it was expensive too). Watching him explain to the customer had some entertainment value though. It was good, and bad all at the same time. If there was one thing not to damage in the lady's garden it was this ornament. He actually had the head in his hand as he was explaining to her how it happened LMAO. You had to be there I guess, oh man it was hilarious even if it did cost nearly 600 pounds!

She was very happy that it was replaced new for old, and there lies the true moral.
