Too cold for herbicide?

It's 35 and frosted for the third time here in NEPA. I'm seeing sassafras, maple and others wilting seriously, some with little foliage remaining. My company still has me applying foliar herbicide on the ROW. I'm no expert, but doesn't this seen a little stupid?

Keep in mind, they expect 95% minimum kill rate on target species. I know thus is the wrong area to part this in, couldn't decide where to place it.
 
I probably should have titled this topic differently. My concern is primarily the fact that the leaves are well on their way to falling off, turning colors and dropping some of them.

My understanding of the foliar herbicides we use, as explained in the technician class, is that the only way it enters the plant is through the leaves, stopping photosynthesis and therefore starving the plant in a way. So if you have no foliage, you have no effect...

by the way, if there are any who are familiar, I'm using garlon 3a and escort in a high volume mix, with mso as a surfactant along with a drift agent and a sticker.
