Anyone looking for a cheap new MS361

If anyone ends up purchasing it I would confirm the picture is indeed correct before you make payment. If the picture isn't correct, I think you have a valid argument to get out of it.

You would need to confirm with the seller that the saw described as being sold is the exact saw pictured in the auction.
It's not the buyers responsibility that the item is properly described, only that the buyer confirm what exactly they are buying.

Once you have written confirmation from the seller it would be difficult for them to legitimately pull a "bait and switch" using a photo different than the actual item.
