Just as setting foot on someone's property in these circumstances will. In fact anything done outside the given channels ( which do suck and are expensive) will have the police intervening quickly these days I am pretty sure.[/QUOTE

Especially if you're in Texas. Seeing as a kid was shot dead there for simply stepping on property to ask directions.

This is interesting. I have responded to more than a few pm's, in here, asking me about contracts and general legal issues, over the years. I have a good "feel" for the letter of the law, and I have never lost in court when suing.

Bouncing checks are a whole other issue, on a whole other planet, in a whole other universe, for me. I see red, literally and figuratively, anytime some pos tries to bounce one on me. I have never worried about legal repercussions in dealing with such scum. Maybe Texas has just given me more leeway than other states might have, without my knowing it. I have gotten my secretary to keep someone on the phone while I drove over to his house and kicked his door, to the point where she could hear my kicks on the other end. I have threatened bodily harm, face to face, to a guy who owed me six bills on a bouncer. I have called business associates on a low-life rubber check writer to the point where he was shamed into paying up. In over twenty-five years, only one SOB has gotten away with stiffing me on a check, and I am still on his trail. I will never use restraint in dealing with thieves. They don't deserve it, EVER! One of these days my luck may run out, but I'll kick that @## when I come to it.

Love it! I have done some things, no door kicking or anything! but man I would have loved to been there when you did LOL!!

Had a guy try and not pay me the insurance money he received from his Insurance Co. Sent my mother in law!
Got it!
SHE MEAN AND SCAREY!
I LIVE IN FEAR!!!
not really..............well maybe sometimes.......most of the time
help me

Kick my door down, unless there's a fire inside, and you'll be greated by a 100lb doberman and on the wrong end of a short barreled 12 gauge with tripple o. Just sayin...

small claims is what we do. If they don't show then they get a bench warrent.

A good friend of mine works for a guy who has on a few times left a load of nasty but logs at the end of their driveway. The good ones filled cemeant and metal.

A Lein on the house wont work.....BUT, a Levy on his non-perishable private property WILL!!!!

depending on your area, go to local magistrate, small claims court & ck on placing a Levy on him?? when the constable goes there to inventory his personal property.....I gaurantee he wont want to lose his big screen tv!!!

However one drawback of the levy is: if you dont have a signed contract then you are SOL.

I had a guy sign my contract, My crew & I did the work, the owner even haggled me down on the price a little before signing!!!! we busted azz & finished the job much sooner than expected......He felt as though he didnt have to pay the full amount....just because!!

I called the police Dept, officer shows up & asks what I want him to do? I want the owner charged with "theft of service", but he said he paid you half... my reply: so when I go into the store down the road I only have to pay half for milk??? officer(very young) replies: I see your point!!! Ill get the paper work started!!!

you have to know what to charge him for cuz alot of officers consider this a domestic problem which needs handled by the courts, good luck to ya!!!

LXT................

If he stopped the check it will have to go to small claims court, If the check was a closed account then thats a felony. If the account was open, and just didn't have enough funds then thats could be a felony if he doesn't honor the check. Keep the check! I always go to there bank. If they will not cash it don't lose it. If he paid You after the job was finished You will win in small claims.

I'm a Union Laborer by Trade, Your rights to protest, and hand bill him are pretty great. You can print and post anything You want to say about him as long as You believe it to be true. We hand billed wallgreens for being non-union built, It took them 3 hours before they asked us to leave the parking lot. So we stood on the sidewalk all day handing out "hand bills". We have set on the side of the road in front a the owner house of a constuction company with picket signs all day long. Your Rights, As long as your in the road right away. They called the police but the police said nothing to us and drove away. One time we was at kellogg community college with the blow up rat, It was off the sidewalk on their property the police where called We said fine we will set it next to the road but if someone get in a accident Its not our flaut, The college said forget it leave it there. People have the right to protest but the laws are tight. You can not threaten or provoke problems.

With all that said, I make pretty good money doing trees, $800 this time of year Well I'd be pissed. Think about it on the next job without a doubt. Set at the end of his drive for a couple days with a picket sign Maybe. Find another job and over price it to make up for this, For Sure

My fellings on this......

You know, I was wondering the same thing, Slayer :biggrinbounce2:

Funny Funny... I don't believe in writing checks anyway. Cash or money order only. Never was that good at keeping track of checks...
