I had a gentleman from Canada that agreed to buy all 60 of my Homelite chainsaws. I gave him 30 days to arrange shipping or have them picked up, its been nearly 40 days now and I haven't heard from him in over 2 weeks. He made a substantial deposit and now I am at a loss as how to proceed. I'm going to wait another week before I start selling any complete saws, but I have already listed some parts here.

Unless it’s an emergency situation on your part, where maybe you’re transferring ownership of the location where all the saws are being stored or perhaps you really need the money right now, I personally would give the man more time. If he made a substantial deposit and it’s not killing you to wait on him, I would give him the time he needs.

I'm going to wait at least 2 weeks before I decide to sell any saws, but then it will be 60 days after the deal was made. I would wait much longer if I had any contact with him, but going dark is not a good sign.

I'd like to sell them as a lot if they don't sell as a lot, they will go individually. I'm going to be pretty close to 6.5k on those 5 saws, thanks

That's my plan, but that's getting increasingly difficult when he doesn't respond to my emails, texts, or phone calls. I've already gone way above our agreed to deal, if he doesn't care enough to contact me and lose a 1250.00 deposit I really don't know what to do. I could have sold many if not all of these saws by this time and without any contact from him I'm not going to wait much longer before I make other arrangements.
 
I would get his attention and send a text., email and voice mail that you are returning his deposit and what would he prefer, check, money order, etc. Whatever his misfortune or reasoning for dropping the ball shouldn't leave you not selling and wondering.

First of all, I have left many messages and texts via phone and email for going on 2 weeks, Second when he entered this agreement it was completely above board and agreed to there would be NO returning of any deposit if he failed to arrange pick up. He does not and will not change those terms of our agreement. This is going on 2 months of time I've waited when I could have been making other arrangements. That's exactly what's wrong with this world, people that think they can change the rules to fit their needs, it's never about the money, but rather when you abandon principles and rules YOU make the principles and rules meaningless. Look at many cities around our nation that have abandoned rules and principles, they are no longer a civilized society. What is this world without laws and rules they are anarchy and chaos? I will wait longer, but not much longer.
 
Contact the Law enforcement officers in that area and have them do a well being check.
Might have to issue a Amber alert.
They might know which cell he is in.

He will have a good excuse if he ever answers back. (and I've heard several of them GOOD excuses from people doing phone calls and emails)

The guy lives outside the US, so I'm not comfortable contacting law enforcement about him as this might cause him legal issues. I would think that unless he has passed away he could have had someone contact me and explain. I had a guy that contacted me 13 months after a 900.00 eBay sale. I held the item for almost a year, six weeks later he contacts me after I got rid of the item. He lived 200 miles from me but claimed he had been deported to Iran, now I hoped he was one of those 7-11 owning Islamist and not one of the mechanically exploding vest wearing Islamist, as far as I know they have eBay and internet in Iran.

If an agreement for non returnable deposit was made, what prevision was made if remaining payment was never received. Inform that the deposit will not be returned, as agreed, but saws will be sold if resolution is not made in ( whatever time frame your comfortable with). We all have an opinion, you have to make the decision YOUR comfortable with. Good luck and hopefully it works out for both ends.

Our original email stated there was to be a NON REFUNDABLE DEPOSIT if the saws were not picked up and the remaining balance paid. I have attached that email to every correspondence I've had with him as well as on texts and phone messages. I've sold hundreds if not thousands of items on eBay, Facebook Marketplace, auction sites, forums, and groups and situations like this are not an anomaly, it happens more than one might think, usually not for this much money though. I'm still waiting and will wait for at least another 30 days, but if after 90 days passes I don't think I have a obligation to continue waiting
 
Sounds like you already know what you need to do, but want another opinion because you're trying to be a nice guy. Stick to your planned agreement - sell the saws. As you said, he should have found some way to respond to your messages. If he shows up after you sell the saws and you want to feel better about it, return the deposit.

The only reason I was even selling these saws was I'm sick of the crap that goes on in any collecting hobby (also collect other vintage items), the liars, the cheaters, the posers and the know-it-alls. I really don't have time or the inclination in dealing with these types or to try to weed them out from the majority of good folks. I've deleted social media and may even cancel internet. I'm inclined to only deal with people face to face these days. It's just not the people who don't know if they are a man or woman, but those that don't have morals, ethics, or have the ability to tell the truth. I don't accept gray ethical areas that a feminized male society has seemed to have embraced. After 90 days they will be all boxed up and stored in my attic, I'm not going through this 60 times with 60 people or even one more time with one person.
