Here is a picture of some trees my city pruned . It made my local paper I thought they would make a good discussion piece and would like to get everyones option I think I might drive out tomorrow and take a look and see what I think and take some more picture . I the article said the city only pruned 14 ft . I would say it looks more like 20 ft . She is saying they butchered her trees .I know the area it kind of just a back alley street with little traffic . You can find the article in the Newark Advocate website just search trees . Tell me what you guys thinks and I will try to get some better pictures for you .This was not done for line clearance but for view of traffic.

Granted it is a side street. I would bet there was alot of deadwood they took out of the trees too. And the lines need to have clearance.

I can see a bunch of deadwood in themfrom that one photo. When was the last time they were pruned? How can someone else "ruin" something the original owner doesnt care for themselves?

The most important question is did she give them permission to cut private trees? If not than theres going to be plenty of grounds for a huge lawsuit.

In Massachusetts the cities and towns are technically responsible for all trees that are within 10 ft. of the public roadway (as defined by Mass. general laws ch. 87)

osb you own a city?

I can she isn't happy that is for sure. I wouldn't be happy either if they my trees. Good job of cutting the branches but I would prefer whatever privacy they had to offer.

It sounds like they gave her notice and she did some pruning herself . I know that they needed pruned for line clearance but I dont think that is the reason they pruned I just think it was to be able to view the intersection better I am pretty sure that this is a really slow intersection with little traffic . If I am not busy tomorrow I am going to take a look see what I think maybe get some better pictures.

No don t own the city it just where I live .I did not do the tree work I am just hoping to get some feedback on the subject .thanks

Milwaukee will do the same thing, they bill by adding it as a speciall property tax assesment.

I think thier standard is 16 ft for truck access. I allways use 2 8ft poles to guage when I'm doing a private tree that encroaches on public ROW.

It does "look" like excessive raising, but how far down were the limbs drooping? All she ahd to do was call for an inspector to come out after she had "corrected" the problem.

en·croach (ĕn-krōch') pronunciation
intr.v., -croached, -croach·ing, -croach·es.

1. To take another's possessions or rights gradually or stealthily: encroach on a neighbor's land.
2. To advance beyond proper or former limits: desert encroaching upon grassland.
3. Football. To commit encroachment.

[Middle English encrochen, to seize illegally, from Old French encrochier, to seize : en-, in; see en–1 + croc, hook (of Germanic origin).]

Every town has their share of crybabies. Maybe she would feel better if someone had gotten killed at that intersection.

It loks like a typicl pruning job. the catch is that if a limb falls laibility the town obviolsly wants to avoid paying
as does the power company and any related services . rembr cable ect lose money if they are not providing serice .
it isalso a safty issue
Often crews leave banches for wood scroungers or the land owner . Hell I had a hiuge oak droped just went out and said put it opn the grounf chipp anything lessthant 2 inches as can use the kindleing . i went out and took car of it after they left and had 2 cord + of free fire wood

Ifter isaporble a land owner should ask the operator or town
then evey place has its busy bodies and cry bbies .
as for pirvacy i palnmt lowere grwon plants such as Rhodies azealias , arborvites ect in a hdge according ot alnd owner desires after talkingot them so it does not lok like i just planted them in straight line looks j kind of fake to me

At least they look like proper cuts.I've seen some citys and villages leave 2' stubs. I think it looks great ! Tell her to plant some low-grow next time and she won't have the problems with trimming up so high.

I would have say these are not the right trees for the right place . Even most low growing plants are going to block the view of the road .

If is is possible a land owner should ask the operator or town they usualy are tild if pruning is gongot take place
I have droped large trees near power lines both my self and the powercomany told the land owners near by this was on right of wat and the land owner hire me to just droop the things and clear them out oif the road he will clean up all the reast . hwey esay money for me we just took the lnesdown and notifed customersa few weeks in advancealong with knocking on doors and telling them if possible

Low grow can block vision, but it would sure be better than white pines .Besides those trees we planted on city property .Too bad but it is the city who can do as they please. It is just the same as when someone plants trees on a neighbors property line, they have the right to trim back anything that is one their side.Ask the homeowner for the permission slip that they got to plant the trees there in the first place.Just chalk it up as a lesson learned for the homeowner.

It looks like a typical pruning job not all that bad . She does not have much of a gripe . If a limb is on your land Ibleieve you own it .

I am fairly sure that there are reguations as to how close ot a roadway treesand branches can be .
It is a safty issuer if they block visiblity
in a town I work on occin onperson refuse to drop a large maple that obstructs visiblity in a road making a dangerous intersection even more so
This person has been held liable in to civil case and had to cough up alot of cash for medical bills and repairs bying as new get this Excursion !

Sop youcan be held liable
.She should be happy also crews often leave wood for the land owner or sroungers I have asled when a huge oak was droped acoos from my folks place isaid just chipp 4 inches or smaller ill clean it up as long as it is off the roadand out of the way
2 free cords and atesrun for my 575

there's nothing to say, if you haven't seen the tree BEFORE and AFTER pruning. one day you take huge broken limb off the house, leave large cut on the stem and next day some dude say " this tree is disfigured, lopsided, butchered..." pictures taken BEFORE pruning saved me more than once.

Yeah I wish I had before pictures . I went yesterday to take a look . This is what I think happened .This is actually a back alley intersection maybe 10 people would drive down it . It a pretty small road . I figure that the construction guys working across the street got tried of trying to pull trucks in and out of the tight alley with the trees so they called the city .They are building new apartment complex that she probably is not happy about being built but now she has to look at them I would guess this is way she is so mad .

I know about a case of pruning job done by very big and famous tree company that resulted in free planting of fair size trees in order to restore screening effect destroyed by "pruning". guys living in some areas of the city are either lawyers themselves or know pretty good ones. scary bunch.

One of my clients did a brush removal for his client; buckthorn, honeysuckle, prickley ash...they flagged across the lotline and he ended up getting sued for 50k nad settled for 12k even though his RCA wrote that the value was improved by the loss of the invasive material. The property owners valued the screening and green of their trees.
