Believe the whole process is called due diligence, and if the sh*t hits the fan and you have not demonstrated to a court you have done everything possible to avoid a situation, you are the one in deep kaka. People are going to act in bizarre ways anyways, but if you and your workers have acted within the law and IAW all regulations the potential for a huge loss is greatly lessened.

Indeed, when and if something serious goes down, you will be a whole lot happier if you had your cones, signs, flagging, etc. out.

If you practice 'due diligence' then no matter what happens your conscience will be in much better shape. The death of some would certainly be beneficial to society but it would be pretty traumatic for us even if we played it all by the numbers.
Last week I had a kid come onto the property where I was working. I was sawing and feeding the chipper. ProForest system in place, earmuffs deployed, orange saw chaps on. This little cretan rode his bike up behind me and SCREAMED "Dude, I like your pants!".Then he pedaled out of reach- There were girls watching so I guess he was showing off for them. This scared the everlovin' doodoo out of me. I think I uttered an expletive. I was mad at the moment. About 2 minutes later I was ready to beat the excrement out of the brat('course there wouldn't have been anything left  ). I hope he grows up to be something more than chipper test material but I doubt it.

cones

when working on the roads we use a vehicle with flashing hazards and a flashing orange light folled by a line of cones and preferably at least 2 on the road. when it comes to felling the stick / tree the traffic is stopped, road may be blocked by a vehicle accros the road if we are short of a stopper.

if felling a tree away from the road with a pullline (always on roadsiders) teh traffic is stopped incase anything drops, all traffic stoppers are in hi viz vests and away from the canopy. i normally carry a saw (sometimes on tickover) it gets peoples attention.

pedestrians are the worst, you have to scream STOP at em sometimes, shortly folled by no not under the tree...

Yeah, i have been very surprised at what people will go through to get into the work area- cones- signs- flagging- etc...

That is why I like to use off duty police officers in uniform. They command far more respect from people. The PD here actually has a number to call to hire their off duty officers for traffic control. Most construction companies here use them, not flagmen. People just normally slow down when they see a police car and officer in uniform standing on the street.

Oh, get this, this just happened today, I showed up to trim two narly silver maples along another busy street and there were 5 cars lined up under them. Took one look and said "No way Jose" walked off the job again. Is it just me or is this guy just not getting this??? The thing is on this jobsite is that its not the home owners parking under the trees its every one shopping or the construction workers from the job site just around the block. I was half temted to have one of my buddies call him up and tell him that one of his tree guys dropped a branch through the rag top of his jeep while he was working at the construction site. And then when the contractor calls me I will just say, "yeah the jeep was right under the tree and we couldnt find the owner and after we tore up his topper we still couldnt find him so I just put on of your cards in his windshield wiper and left" Kinda pull a Jerky Boys or Roy D Mercer on him.

I don't unnerstand that. Vehicles are always moved outta the drop zone.

ALLWAYS!

Period.

I didnt even set a line in those trees, I took one look, rang the door bell, even left a note then left. I was just thinking about playing a practical joke to maybe teach this clown a little lesson.

When we're doing work on city streets like you're describing, we try to either block off the area the night before to prevent parking or call the local police department and have them do it for us. Usually they'll either post the area if given notice enough or they will actually contact the vehicle owners by way of their license plate numbers to have them moved. And as far as street closures, if given 24 hours notice to all the emergency services(police, fire, and ambulance) we are able to close down the street and reroute traffic, assuming it's not a major thoroughfare. If so, then it's flaggers, signs, and cones.
Even then there are still idiots, though. We have had several people drive through the drop zone, even after being flagged through on the detour route. I was dropping about a 40 foot limb onto a street, pulling with my skid steer, and a guy stopped under the branch as it was hinging over. Thankfully for him, he looked up to see what the skid steer was hooked to or he would have been a dead man. He flew out of the area as fast as his little S-10 would take him.

Around here you cannot block the parking off, they will either just move your cones, or steal them.

In the past, I've gone to a big job the night before and cut a lot of brush up and asked the client to put it in the parking zone over night.

Kenn, you need to sign an agreement with the primary contactor so he pays you travel time when yo have to walk off a job due to his not clearing the DZ's prior to your showing up.;)

"the primary contractor is responcible for ensuring damageable property is removed from the work area, and that proper safety measures, IAW all state, local & federal laws..."

oh, you need to keep working for him for a few more months

BOY I am really glad to be in a "rural" area where we can just shut roads down and don't have to deal with the non-sense.
