Chipper Dealer Problem

I purchased a new 2012 Terex / Woodsman 730 chipper at the end of Dec. 2012. I bought the chipper sight unseen and when I went to pick it up, the chipper they told me was a brand new 2012 unit turned out to be a demo unit with a 2011 sticker. The salesperson tried to get me to take the chipper, offering to negotiate a better price but I told her I paid for a brand new unit and that is what I want. Anyways, my new chipper has still not arrived.

So my question is this - I know dealer support is important and it doesn't look like a small company like mine matters to this equipment dealer. I've signed papers, so I am wondering if there is any way to get a refund and buy a Bandit or Morbark?

If you have something in writing saying it is a 2012 you have a legal gripe. If you don't then try to beat them down on the price.
 
Have you gone above the salesperson and talked directly to the owner / manager?
Is there fine print in the contract saying the deposit is non-refundable?
I would also not be impressed with the bait and switch scenario.

Is the chipper local or far away that you didnt get to see it? If the sales invoice say 2012, they better get you a new 2012 model or face a lawsuit.
 
The dealer is not that far away but I bought it sight unseen based on the reviews of the machine. After I found out that they were trying to sell me a demo instead of a new 2012 chipper, I actually ended up paying a little more for a new 2013 unit. The problem now is that the chipper has still not been delivered to my shop although they assured me that I would have the chipper within 3 weeks time.

I really like the Woodsman chipper, but I am not pleased with the dealer and can only expect their service in the future to be poor. So that's why I would like to get out of the deal and try another make of chipper. I don't think I have a way out so I guess I am just relaying my experience. Next time I will take the time to visit before making such a large purchase.

I am looking at buying a used grinder from global equipment exporters. I could have it shipped, but there is no way i would spend that kind of money without first laying my eyes on it before any money transfer hands. I am going to drive 12.5hrs and really look the machine over good. Pull all the guards, and check the belts and everything. If theres something that i dont like, then the price is gonna be re negociated or i will drive home without a grinder.
 
I bought my asv from minnisota. Found it online and flew out to check it out. Everything worked out ok. But I needed to see it first. Got a good deal on the flight because my buddy works for United. I got a round trip flight for under $100 and all I had to do is wear a collar and fly standby. Always. Always. Always see it in person.
 
I wouldn't be afraid of a demo unit If it has low hrs on it. You can tell at first glance how a chipper has been treated .
I feel your actually better off with a chipper that's been demoed a bit. Most brand new equipment comes with a few bugs from the factory. It can save you a lot of aggravation and down time if the salesman finds them on a demo and has them fixed before you take delivery.

They already lied and he cant believe they would repair it anyway.
 
What does the contract say about the delivery time frame for the machine? How long has it been since you signed it? Do you have any communication in writing or is it all verbal? I think that I would send them a certified letter and demand your unit within 7 days or advise them that you consider the contract terminated for failure to perform.

A call to manufacturer/distributor might be in order to let them know the type of antics their "dealer" has been using.

The guys down at Globel Equipment Exports are a great bunch of guys. The grinder was exactly as described, and Randy is very knowledgeable. When I buy my next piece of equipment from them, I know its gonna come as described, and I will just have them ship it to me. I would highly recommend dealing with them, if you need any equipment.

The sales rep assures me that the Woodsman chipper will be here this week. My current chipper is a Mitts and Merrilll which has been a solid, reliable machine that I bought used several years ago. Unfortunately the manufacturer of the M&M, Karl Kuemmerling, went out of business recently. Anyone know what happened?
