I just won that auction. Then I saw this below.

What do you think I should do about this? Trust me, i have been in contact with the seller. By the way these auctions were going at the same time.

Definitely do not send any payment. You can contact eBay and they can verify who is selling what saw.

yours looks like the copy pic.

the other looks more legit at a glance to me.

best of luck to you dude!

make some kind of report to ebay now and cover your ass!

I would guess the one you bought is a scam, since it looks like they mostly sell women's clothing and other foo-foo stuff. Nice catch, hopefully before you sent payment?

I havent sent payment. In one message she says someone copied her pic. Then she says she copied it and didnt understand. She also says her brother is bringing the saw to her. I asked for legit pics. Still waiting. The only thing that dont jive is the feedback is perfect with 800+ transactions.

I have every message saved.

When i looked at the completed auctions, the one with multiple pics shows up, but mine does not (I used the make offer choice to buy it).

However, it shows up in my ebay.

Dang, that's a tough choice, 810 feedback vs 385. Which one started first? If your saw is the legitimate auction then it'd be a shame to let it go (if you are happy with price). I would contact ebay first and hold payment until you get to the bottom.

She just emailed me pics and its an 036 Pro that appears to be in decent shape.

She said "my mistake" :dizzy:

Now what to do. I kind of still want it to flip and pay some people, but should I offer a different price?

I have neve been in this situation before.

At this point I'd leave it as she has 2 deceptions. 1) She used someone else's picture and 2) she said wrong saw size. No telling what else is wrong without honest pictures and at this point can you trust her?

That makes sense, but part of me still want that saw to flip. The feedback part kills me, as she has good feedback. The pics look good for the 036. (Is that CAD talking?)

Well part of me says if she has good feedback then she must be legit..

The picture does look strange though ?! :censored:

See what eBay says.. they should respond fairly quickly.

I am wondering what might of happened if you had not seen that other saw.. chances of actually picking up on the other sale was not 100% by any means.

If you do pay use PayPal, they do have buyers protection, however personally I have never needed to use it. I have always had good results with eBay.

She stated 038 and your saying its really a 036. I think Malibu Stacy should be offered $75 - $50 less than what you won it for. I seriously think she will do it. Probably don't want her feedback destroyed. This may be a blessing in disguise. That would be a steal for a clean 036.

Im going to try that and see what happens.

another option is:

the seller has an option to cancel the transaction.

it basically means that the auction is void, no harm no foul to either party.

what to do is up to you.

offer her half of what the buy it now was for your troubles specialy since you didnt even buy an 036 pro

Good idea.

The seller can't just cancel the transaction, the seller can submit a cancellation request to the buyer, but it's the buyer's call. The seller can just refuse to ship and take the negative fb, Even if the buyer agree's to cancel, the feedback still works on a canceled transaction, positve or negative.

I would want a big discount like the 50-75 mentioned earlier, and then be prepared in case the saw is smoked to file a dispute, or I'd walk away and give the negative. Deception, rarely gets better. Even if these folks sent you the saw, remember that they used an incorrect picture and would have had no problem shipping you something that you didn't buy in the first place.

Clutch find though, you could have missed it altogether.

I offered 130.00. Lets see what happens. The bar and chain dont look great, looks like safety crap chain. Powerhead does look to be good, but thats a gamble after the mislead anyway.
