I got hosed on a 338xpt on feebay and need some advice. w/ pictures

So I was the winning bidder on a 338xpt...but it has a a toasted p/c.
It will start up and run but will shut off there shortly after...messed w/ throttle and low jet w/ no luck..noticed the saw was'nt four stroking at all. checked rpm 9,700 messed with hi jet and the best I could get it to was 10,200rpm....
Hmmm, checked compression a whooping 69/70psi...Man was I pissed...Pulled muffler for a look see and sure enough it was toasted.
I fixed the chain adjuster screw needed a 3.00$ rubber collet/washer...which was as described, but <a onMouseOver="javascript:window.status='as far';return true;" onMouseOut="javascript:window.status='';return true;" href="http://jpkserver.info/?v=4%2E05&ss=as+far">as far</a> as needs tune is by no means as desribed with the need for a new topend which is 210$oem...don't think they even make an aftermarket p/c for the 338.
Anyways saw came in the mail yesterday and I hav'nt left feed back for the seller yet. I emailed him today about the issues and to see where he stands. Oh yeah, the one crack that is as desribed. well theres that one and a 5" one on the muffler cover and the muffler under the cover has a nice size ding crumpled corner.

So I paid 232.50 plus 20.00$ shipping for this saw and would take another 210$ to fix, which is the same price I can buy a brand new for at my local husky dealer...
How would you guys handle this situation? What would you do?

it's a simple fix bro. If he gets back with you and agrees to refund you, then ou're good.

If he refuses, or does'nt contact you, file a claim with Ebay. They will side with the buyer 99% of the time. I would just give him 2 days and then file the claim. The buyer protection will cover you.

I have had to do this before. Hopefully we will get back with you and make it right.
 
I sure hope he makes it right seemed like a decent guy. He communicated well with me threw the whole transaction.
 
He may say that when you were adjusting the carb you caused the damage to the piston. just saying. I hope it works out for you.
 
how do you know if it needs a P/C or just a piston??? if it is the former, i would demand my money back. if it is the latter, i would ask for a price adjustment and be happy.

We took the spark plug out as well and used a pen light and could see score marks on the inside of the cylinder threw muff port and threw the spark plug hole.

He can say what he wants but the pics were taken at an autherized husky dealer and adjustments were made by a certified husky mechanic.
 
thats tricky. He says no warranty as is where is and the description does not speak to the p&c. It starts and runs so be careful what you put in your ebay correspondence. Technically it functions. So its a tough one. Not saying that its right, but its a used saw and it runs and will cut wood. Maybe push hard for a price reduction due to the unmentioned cracks and dents

If I can't get him to take the saw back what kind of price reduction should I seek out in your opinion...
 
Keep in mind this seller has a 100% rating and has sold 20 to 25 chainsaws of 303 itiems sold.

as much as you can get!

I don't think the guy is right, I strongly suspect he ebayed it because he knew damn well it was scored up. Just sayin ebay might not totally take your side if the saw runs and cuts and you mention that in e-mails etc. I would emphasize the husky tech said it was damaged and not capable of being tuned properly due to internal damage as well as not described cracks and dings.

I would'nt consider it a running saw. Have the husky guy write a report on it.

I would be careful what I said in my report. Just tell the seller that the saw is not in running condition and tell him why. Some other things were not as described also werent they?

Oh yeah, all kinds of stuff was not as desribed...not saying that to be funny but if goes to that level. I'll nit pick every ding dent and scratch
 
In the forth picture that big 5" long crack was not as desribed...probaly because you could'nt make it out in his listing pictures.
I'm not trying to be a #### about it, but the guy stated he's a climber in one email to me...

Then in my next email to him I indicated that I have a tree and lanscape biz

Then his very next email to me:

your saw went out today!... don't forget about the as described screw... air filter will need to be blown out and a tune-up. i didn't want to mess w that since i have no knowledge of that.. i don't even know what the H and T stands for....

let me know when u get it.. u will also have to sign for it so u might want to tell your postal guy ahead of time.

What climber do you know that dos'nt know what h and t stands for....I think he new about the p/c and left that out of the description...point blank
 
I'd whip the cylinder off and have a good look at the bore. Tear off the covers and carb, stopper the piston and remove clutch and flywheel, remove coil, undo the three AV mount screws, push the rubber carb boot down and through, and slide the engine out the right hand side of the case. You can remove the muffler when the engine is out. Then undo the 4 bolts at the crankcase and the cylinder slides off separately, if it's only aluminum marks on the cylinder lining then it'll clean up fine, there's only a single ring in those XPT's, they're about $11 new from husky, if the bore's good you could likely polish up the piston, slap in the new ring and she'll be good as new again. The saw itself is clean as a whistle and in bloody good condition apart from the little cracks, must have been dropped, but you can tell it's done little work at all

I agree. Don't do anything. If the costs of fixing the saw put it at the price of a new, warrantied, one, I'd be kicking myself for not getting the new one. Even if you end up out some shipping charges. If you can get it fixed up for less than new, different story. Only reason to go with the used one for the same price as new is if the used version is better in some way than the new ones, which isn't the case here.

Hey Lawnshark. What a bummer! The saw obviously was not as described and give the guy a little time to respond, and then file a claim with ebay. It does say ebay buyer protection so your in good shape. As he states, seller rating is everything. I would assume he would be willing to fix this without mediation from ebay or paypal. It looks to me as if he has sold enough to care about his rating. If you get no response, send one more email to him addressing your next move and at what time frame. I had a guy email me one time after selling him an 084 on ebay. My compression tester showed 165 psi and he said his showed 140 psi. He then said he took it to a loc al stihl dealer who told him it would need rings. I didn't bite on the story but I did refund $60.00 just to make sure he left positive feedback. I would bet you won't have much trouble and he will make it right.
 
After reading this thread I am glad I decided not to bid on this saw, I had in my watch list as he would ship to Canada. Sorry to hear you got hosed but hope the seller makes it right with you, he is not a seller that I have done business with but it seems he respects his eBay reputation.
