Talked to a internet retailer today that sold Husky and Jonsered. He claims that several of the large internet sales firms are going to sue Husky USA over this new policy. The basis of the suits will be in regards to antitrust issues.
Now the guy could be full of ****, but if this is true and a legal precident is set I would think this would shake up the whole industry.

this could get real interesting.

Given the status of our legal system and the precedent for large companies to cave in the face of a legal onslaught whats the odds Husky USA throws in the towel before it ever goes to court?
Winchester arms did this exact thing in a patent infringement suit last year that most people thought they would win.
Sometimes its easier and more cost effective to change direction than to battle it out in court for years.
Of course all this is speculation and the whole thing could be the fantasy of the individual I talked to.

Lawyers

I see this getting real expensive for Husky and the Dealers who would want to sue. They better sit down and decide how much they can afford to spend on legal fees VS. losing the ability to sell on-line. It might not be that easy to determine which route would be more costly....

The retailers can cover corporate lawyers up real quick. If you saw the caliber of most of these attorneys/ambulance chasers done OK, It doesn't take much.

I've been in arguements with lots of them and they chew up nicely.

It's cheap if you're smart.:hmm3grin2orange:

Given the fact that these new rules dont apply to the distributor that covers the west cost I find them seriously misguided. What sense does it make to shut down all internet sales except those on the west coast?
One thing is for sure. Baileys has to be licking their chops as Husky USA just knocked out 95% of their competition.:dizzy:

I've got mixed opinions on the whole situation but i am glad that a certain retailer (i wont mention names) that is only a few hrs away from me apparently will no longer be able to sell saws so cheap that if i was to match prices i'd have to drop the husky line. Also, anyone notice that most of the pricing issues are in chain saws and not as much with trimmers and blowers? Also, I'm curious as to how it came about that husky usa has all of the US except cali, nevada, and hawaii. How did they get an independent distributor? Bailey's and other dealers out there are definitely paying less for their saws than we are.

If they don't cave, expect a multi-year court date...

when several of honda's largest dealers tried to sue them over disallowing internet sales of generators, trimmers, mowers etc., honda told them "you'll run out of money before we do"

the thing is we wont be able to afford new saws

If we could buy at prices at least close to if not equal to what baileys and other online retailers are, we could be more competetive with them in pricing. If they don't do something to fix the current situation they are going to lose a lot more dealers. Nobody wants to carry a line they can't make anything on.

the wiggle room just isn't there for a midsize dealer like us:(

Do you guys really think that Husqvarna USA hasn't though this out? Is it possible that Husqvarna Sweden is behind the whole thing and the renegade distributor is in for a wake up call? Husqvarna Sweden does not allow internet sales anywhere else in the world, do you think they will let one distributor in 3 states makes their own rules? I'm waiting to see the final outcome.
