Another ebay gripe!

Sorry guyd but i have an ebay saw gripe to get off my chest! Week before last i sell a 262 on ebay. Guy that wins is zero feedback, i wasw kinda worried then. It ended on a friday night. I advertised that it would ship the following monday or tuesday. Well, my dad became ill saturday and was in a hospital all week, so i knew i wouldn't get the saw shipped by tuesday. So, i sent the guy a message describing my situation, and he agreed that a shipment later in the week would be fine, as long as he had a tracking number by friday. I got it shipped and got him a number on wednesday. usps. So he files a non received item dispute against me only 4-5 business days later. Everything is still calm, I tell him that there has been a lot of flooding and it may take longer. He ends up getting the saw in 6 business days, but won't drop the dispute, says he wants to check it out further. I told him to drop it because he was using a non recieved item case to hold me off, and paypal was holding my funds. So, he held me until today and i finally escalated the dispute to a claim. I told paypal i wanted him off my back, he was just wanting something for nothing. Now he changed it to a "item significantly not as described" claim. Says compression tested 95lbs at a dealer and it needs a new handle assembly and wants at least a 150 dollar refund. But, i stated the saw had dents and dings in the listing, but nothing affected performance. And that compression felt good, but i didn't have a guage so i couldn't provide a number. And that it ran well, which it did, and all i stated was true, and i added as-is to my auction. I don't know if it matters or not. Anyways, anybody got any ideas about what i should do? Finallly, the guy griped about the price, and it was his only bid. 335 dollars! Said it was too much to pay for a 15 year old saw. Below is the item number. I just hope paypal is sensible on this. So, tell me what you think please.

I am sorry about the situation this ebayer has put you in.

I have no words of wisdom for you. I am having internet saw buying problems of my own right now.

He bid knowing it was a 15 year old saw and what he got was a 15 year old saw. I am sure pp will see things in your favor.

I don't know. He has already tinkered with it. Took it completely apart and found light scoring on the intake, which i didn't know about. I stated in the description that i pulled the muff and it looked good, which it did, but thats all i did. I don't want it back. He wants a 150 refund for a new cylinder kit and rear handle. Thats what he claims in his dispute. But the dent is clearly visible and affects nothing. I had the saw a month and it didn't leak a drop.
 
If you stated as is... tell him to go fly a kite in a hurricane!

I did, but he's still dragging it out. My paypal account is now holding to -295 dollars because of this. I had it at +54 dollars to pay my ebay fees, now the dispute put a hold on 360 dollars, so im in the hole, and i can't get my money to pay my fees either. I listed the item number if ya'll wanna see the auction.

Been there, just be patient. I know its hard to do, but there is nothing else you can do at this point until Ebay does their thing. i dont care if I get banned, but I want to find that buyers handle on ebay. I have a special hatred for worthless pieces of dog feces like that!
 
I buy project saws on Ebay all the time, expect the worst, hope for the best, it is an auction by all means. I also pay within a few hours of end if not minutes,i don't understand how people can be so retarded!

I have a feeling this guy is an ebay "pro" who prob was kicked off or had bad feedback,and started a new name, because he just joined the 9th of september, 2009, and im his only purchase.......
 
Sounds more like he already had one and bought yours to use as parts. I just got back my 385 that I sold to someone local on CL. He called me up this morning #####ing that it had no compression. I went to pick it up and give him his money back only to pull the cover and find a different cylinder on my saw. I calmly explained that the original cylinder was marked with part of the serial number on the saw. He got belligerent and told him to call the sheriff and we could explain both our sides and he could let myself and the sheriff look at the two 385s he had on his shelf that I saw. That ended that discussion real fast.

9/26/2009 10:42 PDT - Buyer: Chain saw: damaged rear handle/fuel tank and low compression contrary to description. Local Husqvarna dealer just tested compression at 95 lbs. Exterior damage could have been caused by the poor packing job, have no way to know from this end . Good used rear handle will cost ~ $50 and piston, ring & cylinder base gasket to fix low compression is $96 plus 6.25% tax ($102.00). I am currently willing to cover the cost of labor myself. Requesting a refund of $150.00 to close claim.

And the message he sent just after i asked him to drop the non receipt

9/26/2009 08:36 PDT - Buyer: According to emails from Paypal, "A closed disputecannot be reopened or escalated to a claim.".Therefore, I cannot close this dispute until I am certain that the saw is "as described" since once the dispute is closed THAT'S IT!. You are jumping to too many conclusions here anyway. I paid $360 with shipping, which is a LOT of money for a 15-year-old chainsaw! Therfore, I suggest that you chill out a bit, as I'm going to do what I'm going to do, and arguing with me will only negatively affect the feedback that I leave you..




He sure does know a lot about ebay to be a first time user with no feedback.....
 
Well the wife road out with me when I went to pick it up and give the guy his refund. I couldn't very well kill the guy and leave her to bail me out for something stupid. I instead used some of the money to take her out to eat on the way home. In the end we got a drive in the country and lunch with me having to deal with a crook for a few minutes as the only real price besides the gas to drive out.

Definitely is an old pro who got booted for something or another
 
Anybody dealt with paypal on this type of stuff? What are my chances of winning? They have basically the same info ya'll got but a little more detail and exact copies of our dispute conversations.
