Hey WM, I read this from start to finish but I couldnt figure out how equal 1/3 shares makes $1500 for them and $500 for you. I probably missed something in translation.

For this deal, I think you are doing the right thing.

For future deals, write it down. Send em an email with all the details and away you go.

Ok bro..a little math lesson..$2000 divided by 3(3 of us doing the work) equals 1333.33 for the 2 guys other than me.. I rounded up for the sake of argument..LOL ANYWAYS..this retard came to his senses apparently last night and decided to agree to the 1400 after I called his bluff..well..now I'm considering just giving him maybe 1200 or less after all the aggrivation he caused me..AND drawing up some sort of document that says this deal is paid in full, and no other action or financial compensation can be sought in the future.
 
Hey guys..I had a little thing that happened today and I wanna know what your opinions are and what options I may have..

I bid and got 2 tree jobs in the same neighborhood last week..a couple of guys I used to work with that had a chipper and truck helped me do them..the jobs get done..now..here the part that gets interesting..what I'm paying them of course..now Tyler used to be my lot foreman at Pennline..and and Joe used to one of the crew foreman I used to work with on occassion..now they own at some level of partnership another tree service.. I asked Tyler if they wanted some extra work as they hadnt been getting much so far this yr and was to be paid in the amount that the sum of the job was to be split 3 ways equally..well..the job gets done..well..Joe wants $1500out of the $2000 total the jobs paid..I offer $1400 cash to his face..he says no..Joe says hes doing me a favor and that I couldnt do it with out him and his chipper blah blah..I tell him hes not the only tree crew in town and I thought we were all doing each other a favor getting some work..whether I bid it too low or not..Its my name in the phone book..I bid and got the job..I stumped and did groundie work..I say thats what the job pays take it or leave it...he doesnt take it..a couple hrs later..he says I verbally agreed to the $1500 I said no I didnt..its your word against mine..he said he called the local sheriff and is filing a lien against the equipment of my business with his lawyer..which as you can see below..isnt that much..I have attemped obviously to pay this retard and he wont budge..what are my options and what do you guys think?

Let me get this straight you are fighting over $100. Just pay him the 100 and begone with yourself, lesson learned. Next time get it in writing or don't do business with the guy if you can't trust his word.

I would uphold your end of the bargain at all costs. Right now you are probably angry with these guys and good decisions are rarely made in that frame of mind. Pay them the $1400 you originally said you would and maybe you can still be friends. But even if not, you can never be accused of being anything other than honest if you stick to a deal.

I would go ahead and pay him what you agreed to.

Very important in this business (or any other) to be a man of your word. Even if this guy has no integrity that has nothing to do with you. Show him that you do have integrity. You never know who might be watching you or who you might have other dealings with down the line. So much more than money is on the line. Often it is building the bonds that let others know that they can trust you with their lives.

Being that you are a marine, I know that you do not need any lessons on integrity from me or anyone else. I'm sure you are just a little hot over the situation right now.

The only reason he's hassling and disrespecting you is cause he's mad at himself. He's mad at himself cause he agreed to be equal with you on this job but can't actually accept that thought. He's got all the equipment and experience and talent and he's pissed he agreed to equal pay. Cause in his mind you two are not equal.
So as you can see it's not really about you. It's about him and what was going through his mind. He's probably not even aware of why he said no to the 1400 and demanded 1500. He was just mad at himself and you happened to be the person in the situation.

If you agreed to pay him 1400.00, pay the man the 1400.00 and write him a check. Make sure you have "Paid in Full" wrote in on the memo line and make yourself a couple of copies of the check. After I handed him the check, I would thank him for the job and walk away and that would be my last business communication with him. If he ever called asking about work, I'd simply tell him that you didn't need his services anymore, that you found someone more cost competitive. The lesson is that you do anything in the future in writing, it's been an inexpensive lesson, take it to heart.

I totally agree with this.

My guess is that he thought to himself that this guy is doing this job using my help and my equipment, hell, it should be my job. I'm sure he was frustrated and angry with himself for agreeing to your terms. He probably thought that you should be getting a finders fee and nothing more. Problem is, he had already agreed to your terms. I have had similar situations. Had one guy that I met here in town with major heavy equipment. He saw me doing a crane job, gave me a card and told me to give him a call. Said we could probably work together on hauling. Well, when I called him the guy said he wanted half of my money to haul on any of my jobs. I laughed him right off the phone.

I'll tell you a little secret. If I can't find a way to do a job without paying anymore that 1/3 in labor I walk away.

What if you get more work? Is there anyone else you can use to help you? What if you need this guy again? I wouldn't burn that bridge just yet unless you plan on taking your business else where.

I considered this already..and he aint the only game in town..I always have ppl calling me to see if I need more workers...whether its climbers..groundies..etc..I will be making some calls this week to see if someone wants to clean-up my brush..in this economy..for $30-50 an hr..I'm sure I'll find someone very quickly..

Too bad your not close I would clean up all you can bring down for 500.00 per load with my grapple truck I won't do hourly though lol.
It is likely both those jobs would have been loaded in one load though or two! It would be done in a third of the time of chipping too.

I would have had it worked out by now bro..but this thing came up called the police academy that I'm in..not really anticipating doing much more tree work this yr..customers enticing me with money have elicited me to reconsider..I'm not working at all other than this stuff..and living on my GI bill money..Yes..once I complete the academy..I fully intend on buying the last couple of things I need..IE..a chipper and a bigger truck..but in the mean time..I am at another masters mercy in regards to handling the brush I generate..I'm getting there..jes gotta get past this next hurdle..das all..LOL
