Ireceived a call from a condominium owner Asking me to give her an estimate
on removing 3 trees in her yard.She then proceeds to tell me that The Cond Maintenance agreement is supposed to remove the trees but that they havent
so she wants me to remove them for her
.She also tells me Not to talk to the condo People about this that she will pay for the removals. Am i about to get into
a litigation problem if i remove the trees?:confused:
 
Dave. When you go to give her a written estimate write on there something to the effect of "homeowner to obtain all permits." That way when the cops come to say "WTF are you doing?" you can show them something that says she is responsible for the work being done, talk to her. It's like land clearing almost... if you have "owner responsible for obtaining all permits" you do the clearing and they don't have their permits... you are fine because they are responsible for it. Lately whenever I have been giving prices for tree work I write in there "owner responsible for all permits"
 
A permit is not going to matter much when it's not even her property , I wouldn't touch this one with a ten foot pole/saw :)
 
Tod, I agree i found out when she called me back she's already invoved in a litigation with the management group!
So i politley pointed her in the direction of my competition :cool:
 
Todd has the right of it. If you want to try to get the work you need to ensure that she is the owner of the outside property.

Most condo's the person who lives in the unit owns it from the wall paint out.

There are a few where they own and maintain the landscapes, but this does not sound like it. Even if you had a clause she signed stating ownership, they can still sue. I'm sure you would not like being in hte middle of a job and be told to cease and desisit.

Sounds like she is fighting with the condo assoc. She wants to see out, and everyone else wants to see the trees.

Give the Assoc a call if you want.
 
i'd stay away from this on brother. if the condo comandos are anything like they are here in florida, run for the hills. those friggin people are nuts!!!! they've got nothing better to do than to "f" w/ people!!! and they love to get the cops involved any time they can!!!!!!!
 
I had one relatively new site that was all dulex townhouse. The type where like every fifth building looked alike.

It was high 90's, humid and calm and my guys were drinking out of hose bibs, and taking rests every 45 min.

we were working on small trees and shrubs throughout the complex, but some of them were so small we could do anything. None of the shrubs ahad any real form.

My instructions wer "trim as neeed"

Complaints were,
- workers laying down in yards
- workers drinking from hoses
- shrubs not trimmed uniform to plan
- some shrubs not touched
.
.
.
I have had one condo that we had good relations with. The rest had nothing better to do then complain about the work
