I doubt much will happen to him being that the charge appears to be a misdemeanor... He should be flogged in public in my opinion...

Maybe not criminally but if the college decides to have the trees appraised for monetary value, they could sue him for hundreds of thousands of dollars. Let alone the cost for removing and replanting new trees. I could imagine this could eat a major hole in his pocket for the rest of his life. If so it serves him right. What a ####head!
 
I don't remember what it is called, but intentional high dollar destruction of private property can be charged as a felony. Public flogging is letting him off too easy.

If it is a missy, it's a hell of a missy. He can do 10 year with what he's been charged with.

If you go the the story on CNN and click print at the bottom of the story, it will bring up a printable page with the 2008 (c) at the bottom. That is in the html code somewhere, and they have a poor programmer who has failed to update that. Not uncommon to see old copyright dates on web stuff as people just fail to update that every year. CNN updated the main site, but missed this part of it.

If the trees are that important I would replant them if feasible. Might be worth a try. They have transplanted some very large trees on "This Old House".

Isn't using herbicides the wrong way a federal violation? There are probably some environmental laws involved too.

But a follow-up article linked in a previous reply about an arrest, ended with:

Federal charges may also be brought against Updyke.

The guy admits to making the phone calls, but says he didn't use the chemicals. What a coincidence.

Yes, they have the oppurtunity to charge him with a lot. Terrorism? That guy made a big boo boo.
 
Sounds like the concentration of chemicals in the soil is so high that to re-use that site the college will need to dig out a large amount of soil and refill. Hope the college goes after him to pay for all the damages to the soil and loss of those huge trees.
