Hey All,

Just wondering if anyone has a clear idea of what the FLSA rulings are on how to pay our climbers when we travel.

I have a sattelite office in FL and I fly my climber down and back every few weeks.

FLSA classifies him as hourly but I don't know if I need to pay him for his "commute" to FL and if so how.

I was thinking a perdiem travel stipend would be fine.

The question then comes, does his travel count towards his 40 hour overtime limit?

Anybody have to deal with these issues? How have you been advised to address them?

Once again Tom, you are right on the mark.

I gotta feeling though that because I'm dealing with two states, possibly two different businesses and an unclear "base office" that I'm going to need a lawyer :dizzy: to help me figure this out.

In Theory my florida registered LLC could hire him for the winter while my VT LLC hires him for the summer. Different WC laws make that not only desireable but fairly appropriate. That part is actually pretty clear.

The hard part is figuring out what to do on the days he is "commuting" to FL

So, just trying to get an idea what ways others have handled it so I can at least have a semi-intelligent (and inevitible) conversation with my lawyer regarding the labor issues.

hourly associate travel pay

Robert. I am an hourly associate in a blue collar job.
When I travel to say Chicago from San Diego all hours beyond my normal commute time of 35 minutes is paid as hourly, until I reach the hotel. Once I check in I am off the clock. --So--Yes the travel day counts as a day of pay, so in my case since California is an over 40 hours equals OT state the Sunday travel time to Chicago and the hours over 8 spent coming home Friday night on the redeye were OT. HTH Dave, of course still see a Jacoby!
