I thought that I was the only one totin around paint brushes in my workbox for clearin off chips and such!

I must have succumbed to subliminal saw techniques through your posts!

What I'd do is talk to the land owner and let her know that she is liable as well if someone is injured on her property, maybe she'll have a sit down with the fat guy and at least get some safety glasses on those kids, nothing worse than a blinded guy weilding a chainsaw at full throttle.

Probably how I'd handle it too. And you are correct there are instances where the home/property owner may be held liable for damages in Civil court, happens every day.

Snitch, no. Should you be a concerned, caring citizen, I guess it all depends on what you're made of. How 'bout some teenagers out in a canoe in the middle of a lake w/o a single PFD on board, much less wearing one? Mind your own business? Or the guy towing 8K lbs tractor on a 7K trailer with one loose chain looped over the front bucket? It's his business right? A woman driving her sedan down the highway at 80mph with four, young unrestrainded children clammering all over the rear, including the deck below the rear window. Just Darwinism, right? Seen first hand every one of those scenerios and got hundreds more too.

No one likes to be told what to do or how they should do it, but there are breaking points where one feels an obligation to act upon their instincts and better judgement. If you think everyone should just mind their own business and not care what goes on around them, that's fine, you're entitled to you opinion. Just pray someone doesn't hold the same opinion if you find yourself in the "S" and they just drive on by with the blinders on.

One more point then I'm burning my soapbox. If you fail to act in a reasonable and prudent manner witnessing (you fill in the incident here) where someone becomes maimed or killed, guess what? You may be held liable too if someone happens to witness your failure to act as a reasonable person would. Case law is full of cases where "innocent bystanders" were later held liable for damages incurred that they may have had an opportunity to avoid if they had acted as a reasonable person would have.

Just food for thought, go about your own business. I promise I won't narc on ya.:biggrinbounce2:

Actually, just hyperactive and A.D.D. and working from home some days so I get up and wander around the yard or out on the deck to give my mind a break from working. Right now my walks have a great view of the tree removal happening next door.

Great thoughts. Funny how one's world view changes after a little knowledge about tort law and liability (let alone if you start reading cases and figuring out how much legal precedent exists that affects so many of our actions -- makes one worried about exactly what the reasonable prudent person in the same or similar circumstances might be expected to do).

I guess I should burn my soapbox with yours but I do enjoy a good rant.
