It is looking like I will be keeping the 400. I went back to the dealer Friday and told the guy behind the counter I wanted to return the saw, that it had not even been started and did not even have 1 particle of sawdust on it. The gist of his answer was "Nope" . I said "Well, that was a 1200 dollar mistake"
I'm glad you are keeping the MS400.
If you take care of the saw it will always have excellent value. Stihl used pro saws in great shape bring $$$$. What's left of your $1200 investment depends largely on how you treat it.

If your dealer took the saw back, they would have no sale for their invested time. Plus they can now sell that saw only as a customer return with an opened box at a discounted price. Some dealers choose to do that as customer service, some don't. Both ways deserve respect. Many people get a dealer's advice, try out a saw in the shop, then find a better deal online. That's probably what the salesperson assumed.

Of course, you can sell the saw unused on ebay and try to limit your loss.

I was under the impression that a Stihl dealer was required to start up and make sure any saw that they sold ran correctly before handing it over to the customer? That would make more sense on why a dealer might not want to accept returns. You can’t (well, i guess you can) bad mouth a dealer for not wanting to accept returns.

I can’t judge anyone for wanting to buy a new chainsaw, but the MS360 is a fantastic saw. The first thing i would have done is fix up the 360 so that it runs better. Now that you have a 400, i’d still go back and fix the 360. No use in having a poorly running saw hanging around, so might as well make it great again. Plus it would be a real good idea to have two saws when you’re cleaning up blow down trees. If one saw gets pinched, you might have to cut it out with a second saw.
