She is definitely using your copyrighted photo without permission for her own rather direct monetary gain. About as clear an infringement as there is, and as others have said pretty slimy all around, even though she does have a big disclaimer in the description now. Whose surprised she is a lawyer?

May not be worth the trouble, but seems that you would win, and she would have a possibly expensive lesson in copyright law.

It's not worth it to me. What comes around, goes around. Besides, I was just concerned for the guys bidding on it more that copyright laws.
 
I dont think it is even about copyright or anything like that, she/he should have responded to the first one of us that confronted her about the picture by appologising, and then making it MORE THAN CLEAR in the acution description that the pic was not the saw she was selling. if that had happened I think the OP would have left it at that.

I have had the same thing happen to me on e-bay, twice. I sold an item, then about 2 weeks later I seen my picture on there. This happened once before. I never contacted the seller or e-bay. My sister (the e-bay queen) has been selling ever since e-bay first started. The first time she had one of her pictures used, she contacted a lawyer, she worked at a legal firm. The lawyer said it was legal for them to use the picture. It sucks people are to lazy or to sneaky to use there own picture. I have not read the entire thread yet, but we should all ask a ton of questions and bug the :censored:eek:ut of her!
 
You will see people on e-Bay that have their name 'watermarked' across the photograph to identify and 'protect' it. But that does not help photos taken from other places on the web.

I see nothing wrong with posting a photo and saying something like, "looks like this (not actual photo)". But this posting implied that it was 'the saw on the right' with the bar and chain removed. That is misleading.

Just did a Yahoo search of this lawyer and nothing came up. Someone should try a Martindale Hubbel legal directory search. This broad might not even be a lawyer.

post a link of her ebay add to her local bar association and see what her 'peer review' thinks !

From what i understand this is a somewhat rare saw, so assuming I win this listing and do not recieve the saws listed in the main picture you will have committed false advertising. Correct? Therefore allowing me to rovoke payment, give negative feedback, report you to E-bay and have you denied any other listings in the future.
