What next? Can't contact ebay seller. No saw!

I paid for an auction I won on ebay two weeks ago Sunday. The saw was coming from two days away UPS. I received positive feedback for my payment, but have yet to get a saw. I've emailed the seller 3 times starting last Friday, called their home phone, and left my number on their pager. They have not contacted me yet, and still no saw. This seller had 100% feedback. What should I do next?
 
File a dispute with ebay and keep pestering the seller, particularly with the home phone number. If you paid with paypal, contact them. If you sent check threaten to stop payment. If you paid by money order, you're probably out of luck.
 
Did you ask the seller to supply you with a UPS weigh bill # as soon as UPS picked it up.

Perhaps you can get your credit card company to reverse the transaction. do you have any fraud protection from your credit card issuer.

Also I think if you use PayPal there is somekind of protection is'nt there.

Lastly ask a couple of huge buddies in the sellers area to show up at his door step with hogs and stomping boots. Politely knock on his door and request your saw or immediate cash refund.
 
Be cool,sometimes they have computer troubles,or could have other issues ,beyond their control .After 30 days,you can contact e-bay.I think Palpal backs a sour deal.I always use a postal money order,that involves the Us Postal Service .I only had one seller,try and back out of a deal.After I informed him of the concept of mail fraud,he saw it my way,but it took 6 weeks .
 
This seller appears to be a female (unless her significant other sold under her ebay registration). I did not see evidence of prior chainsaw sales. I'm wondering if it was shipped full of oil and it's sitting in some post office leaving a puddle on the floor. It was shipped USPS, which I absolutely hate for shipping saws.
 
If your gonna file a dispute do it BEFORE the 30 days are up. I bought a gift off e-bay and it never arrived, I filed a complaint.........after 31 days and was told I had no recourse. Later E-bay cancelled the sellers account and I was told that the auction was "null and void" I responded angrily to e-bay and pay-pal and asked "If the auction is null and void why can't I get my money back from pay pal which is OWNED by e-bay"? They did eventually see it my way but I doubt I would have the same result twice.
 
Paypal Buyer protection is just a scheme to get the buyer NOT to use their credit card and thus eliminate chargebacks. Chargebacks cost Paypal $$$ since they are paid by the seller. If the seller doesn't get paid neither does Paypal. If you don't use your credit card and rely on Paypal the burden of proof is on the BUYER since Paypal is paid by and works for the seller. Your credit card co. works for YOU and if you are not satisfied they will do a chargeback and the burden of proof is on the seller. I found all this out the HARD way. If they won't take a credit card through Paypal and want you to debit your bank account, RUN the other way.
 
I used my VISA debit card, which has the same protection as a VISA credit card. It looks like I'm covered, but I really wanted the saw :angry:

Last Friday, as in 3 days ago? That's not long to give a person when you're trying to get ahold of them. I'd give it a week before I started filing complaints, assuming you've got a tracking number. If you don't have a tracking number, I would just keep trying to get ahold of them for another week, then start filing complaints. I've had good success on Ebay by not accusing unless I've got solid proof, always giving the benefit of the doubt. Explaining your concerns in a relaxed, non-accusatory way generally goes a long ways in these situations.
 
If you are making a purchase off ebay and you do not know the seller or they have low feedback; ALWAYS USE YOUR CREDIT CARD!!!!!!!! remember this is from a seller who has been burned. The buyer always has the option of canceling their credit card. I sold a Stihl 066 that was like new and had the guy put his #$%@ parts in my saw and then tried to get a refund. When I informed him that I mark all my parts with an ultraviolet ink; he then came up with a million excuses for not sending the saw back (this is what he wanted until I mentioned the ink) Any how to make this short he ended up just canceling out his card. I was out the money I paid for the saw and he got all his money back and kept the saw. there was not a thing I could do about it either. :angry: paypal said they won't protest it. the only recourse I had was to put him on the black list. There are about 10 parts dealers that I am familiar with and we exchange bidders to block. A little satisfaction but would still love to grab this guy by the throat. To the main question though you are untouchable with a credit card.

Not the case anymore. Paypal has eliminated the option of not taking credit cards as a seller. You have to accept credit cards as a seller if you use paypal as of 2/11/05. They think the ebay experience is enhanced for the buyer, if they can freely use their card.

I always buy with a card, it's really your only protection. I would give it two weeks and file after that point. DO NOT wait for the thirty days. Make 2 things clear to paypal, FRAUD and CHARGEBACK, paypal will get on it pronto.

Also, you can check your paypal account and see if that payment has been accepted, if not you can cancel it right there, via a hot link. Slim, but I'll throw that out there ;)
 
You stated the person has 100% feedback. be patient. they may be sick or had a computer crash or something. I'd give them a few more days. Then give them hell with both barrells.
 
Cancel the payment through paypal and through a negative at the seller. Fastest way to get a response out of a seller who does not answer mail is for them to watch their 100% rating take a hit. Especialy if they have already given you a positive, no chance for them to neg you back. After they respond and you hopefully get the saw, you can do a mutual agreement feedback cancel if you want to cancel the neg on thier account. Gives you some leverage to get your item. Good luck.
 
I think I'll be paitent for a little while yet. Unexpected things happen, so I will give the seller the benefit of the doubt for now. It's just a little frustrating. I was looking forward to getting the saw, and it's been a no show. I expected 2 week delivery, just because of the USPS, but the two weeks is up!

Better hope the saw is as good or better than expected, or I may feel compelled to give negative feedback on this deal.

Ha! Once someone gives me a negative, (hasn't happened), I say screw it, they're on their own. Why would you continue to negotiate if the buyer has already left a negative? That's dumb.

But yeah, I would wait for about two weeks at the most and then cancel payment and all of that. They may be having problems of some kind, but two weeks is plenty of time for them to get to a computer at their local library or Barnes & Nobles and at least contact you. If he has 100% feedback rating, it's unlikely he's trying to scam you. Give it time, then as Jim said, give 'em both barrels. Ratings are everything on Ebay - they won't want to lose their 100%.

Or tell him you bought his address from one of his other buyers and tell him to keep his eyes peeled for strange occurrences...
 
my answer ,is it worth the trip to where he is.. these kind never expect to see you fill there door..the only danger is an scared man mite kill you..but he will probably just try an get you satisfied an outa his life..cheats usually got no gut or bottum end.. jmo
still you are rite o give him more time.. no tellin what mite be happening in his life.. ie death in the family etc.
 
Peice of advice concerning PAYPAL.

Never dispute through PAYPAL. You probably will never see your money. Dispute through your credit card. You will see your money back this way. PAYPAL has at least 10 class action lawsuits they are fighting right now because they don't return money. If you don't believe me look it up on the internet. They are a SCAM. I had to learn the hard way. If you dispute through your credit card, they have to prove that you received the item or refund the money. It's a Federal banking law. They are required to prove it within 5 buisiness days. The Federal courts have also ruled that their contract is illegal and non-binding (you can also look it up). So don't worry about it.

I don't want to see anyone else scamed by PAYPAL.
 
It would be nice if one could compose a list of 'black listers' that could be shared with the rest of us.

Keep hounding 'em!!
